Information for Guest Hotel Liburnia***
staying at "LIBURNIA HOTEL & SPA" SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ
 
  1. The controller of the personal data of the Guest is "LIBURNIA HOTEL & SPA" SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Cieszyn, ul. Liburnia 10, 43-400 Cieszyn, KRS 0000467097, NIP: 5482663427, REGON: 243294795, telephone: 33 8520 531, e-mail address: recepcja@liburniahotel.pl, referred to hereinafter as the “Hotel”.
  2. The controller has not appointed a Data Protection Officer.
  3. The personal data of the Guest is processed on the basis of a contract for the provision of hotel services concluded between the Guest and the Hotel. The purpose of personal data processing is to allow the Hotel to provide hotel services or other similar services at the Guest's request. In addition, the Guest's personal data can be processed by the Hotel’s video surveillance system. The purpose of video surveillance is to protect the Guest and other people staying in or around the hotel. The processing of personal data is based on art. 6 (1), letter a) of the GDPR.
  4. If the Guest provides personal data defining his/her preferences concerning the stay or services provided, the Hotel may process this data for the purpose of improving the quality of its services, the comfort of the Guest’s stay or to provide additional services for the Guest. This also concerns the processing of sensitive data. The legal basis for the processing of personal data for this purpose is the justified interest of the Hotel (Article 6 (1) letter f GDPR). The hotel has assessed the impact of activities undertaken for this purpose on the privacy of the Guest. This assessment has led the Hotel to conclude that the processing of personal data in a legitimate interest does not interfere excessively with the privacy of the Guest, and this way of processing of personal data serves to improve the quality of services provided by the Hotel, and benefits the Guest by ensuring a better understanding of his needs. For this reason, the Guest’s interests and privacy will not be impacted.
  5. The personal data of the Guest may also be processed in order to carry out guest satisfaction surveys to evaluate the services provided by the Hotel. The legal basis for the processing of personal data for this purpose is the justified interest of the Hotel (Article 6 (1), letter f) of the GDPR). The hotel has assessed the impact of activities undertaken for this purpose on the privacy of the guest. This assessment has led the Hotel to conclude that the processing of personal data in a legitimate interest does not interfere excessively with the privacy of the Guest, and this way of processing of personal data serves to improve the quality of services provided by the Hotel, and benefits the Guest by ensuring a better understanding of his needs.
  6. The Hotel also informs that the provision of personal data is a contractual and statutory requirement (when documenting a purchase made by the Guest using a VAT invoice). Failure to provide personal data prevents the Hotel to conclude a contract with the Guest and makes it impossible to issue a VAT invoice.
  7. The Hotel also informs that each Guest has the right to access his/her personal data and the right to amend, update or delete it. Each guest also has the right to transfer his/her data, limit its processing, object to its processing and to delete it, while the possibility (scope and situations) of exercising these rights depends on the fulfilment of the conditions set out in the applicable law. The Guest, whose data is subject to processing, has the right to lodge a complaint with the President of the Office for Personal Data Protection, if he/she considers that the processing of the data violates the provisions of the GDPR.
  8. The Hotel also informs that the personal data of the Guest will be stored for the entire period in which services are provided to the Guest. The data will also be stored throughout the period of limitation, which also includes tax and civil-law claims. However, personal data processed by the video surveillance system will be stored for a period of 30 days, unless special circumstances (e.g. an accident) or undergoing legal proceeding dictate the necessity for storing the recording for a longer period of time.
  9. The Hotel informs that the personal data of the Guest is processed on the basis of a voluntary consent concluded for the purpose of contract performance. Data processing for marketing purposes is carried out based on a separate consent.
  10. The Hotel informs that the personal data of the Guest can be disclosed in the necessary scope to the following recipient categories:
    1. entities providing accounting services for the Hotel,
    2. legal firms cooperating with the Hotel,
    3. entities providing insurance services for the Hotel,
    4. entities providing IT services and support and management services of the Hotel's IT infrastructure,
    5. entities providing courier and postal services,
  11. The Hotel would like to inform you about your right to lodge a complaint with the authority supervising the processing of personal data.
  12. When accommodation is booked at the Hotel through a travel agency or booking website, the categories of personal data transferred to the Hotel by these entities may include, in particular, the Guest’s name and surname, date of stay, e-mail address and telephone number. The exact source from which the Hotel has obtained the Guest’s personal data can be requested at the reception desk.
  13. The personal data we collect may be subject to automatic profiling in order to match our products to the Guest’s needs. This is necessary to provide discounts.
